Marc Stern, chief legal officer for the American Jewish Committee, said “this was the first appellate test of laws that combat the BDS movement, whose primary aim is to eliminate the State of Israel. As the court noted, Arkansas has broad power to regulate economic activity, and taking a position on a boycott does not inhibit free speech.”
The law was narrowed in May as Gov. Greg Abbott signed an updated version of it, exempting individuals and smaller companies, specifically those with less than 10 full-time employees or valued under $100,000.

Amicus brief filed in support of Arizona’s BDS law
The Zachor Legal Institute, a legal think-tank and advocacy group that combats BDS, filed the suit with the U.S. Ninth Circuit Court of Appeals.
During the last few years, more than 20 U.S. states have targeted the BDS movement with legislation aimed at preventing state entities from doing business with companies that seek to boycott Israel. But this success in pro-Israel advocacy has been met with some pushback, as the American Civil Liberties Union (ACLU) and some pro-Palestinian legal groups have argued that anti-BDS legislation violates the Constitution.
