Biden judicial nominees include union lawyer who sued Israeli consulate at Supreme Court

If appointed, another nominee would be the first Muslim American federal appeals court judge.

Nicole Berner, one of U.S. President Joe Biden’s latest nominees for judicial roles, successfully petitioned the Israeli Supreme Court to overrule the Interior Ministry in 1996, according to an official bio.

The general counsel for the Service Employees International Union and her former wife sought to register their oldest son as a child of Israeli parents in 1996 but were refused “because he had two mothers.”

“After years of litigation, the Israeli Supreme Court issued a landmark decision ruling that required the Ministry of Interior to record both mothers as the parents of one child,” per the bio. “The case received considerable media coverage in Israel and internationally and is considered one of the major civil-rights cases decided by the Israeli Supreme Court.”

Biden’s nominee for the U.S. Court of Appeals for the Fourth Circuit is also active in Jews United for Justice, a Maryland and Washington, D.C. social-justice organization, per her bio.

Adeel Mangi, a new Biden nominee for the U.S. Court of Appeals for the Third Circuit, would reportedly be the first Muslim American to hold such a bench role.

The initiative “reflects a clear recognition that the challenges facing Jewish students and faculty must be addressed directly and seriously,” Dan Gold of UCLA Hillel told JNS.
