Israel’s Attorney General Gali Baharav-Miara approved emergency regulations on Tuesday that extend the detention of Hamas terrorists captured after the Oct. 7 massacre and deny them access to legal representation for 90 days.
Until now, meetings between terrorists and lawyers could only be blocked for 21 days.
“The investigation of the terrorists is complex and unusual, and has unique characteristics that have not yet been known in Israel,” Baharav-Miara wrote in her legal opinion on the matter.
She also said the captured terrorists have a lot of intelligence information to impart to investigators.
The terrorists have “a treasure trove of relevant and extremely important information, both in relation to the planning and execution of the many crimes that were committed, and valuable operational information that could save the lives of many,” she stated.
Baharav-Miara also said that if terrorists meet with lawyers there is a danger that it would foil the investigation.
“In view of the expected continuation of the investigation, there is a fear that leaking information from the investigation could lead to disrupting the arrest of others, hinder the discovery of evidence or its capture, and disrupt the investigation,” she wrote in the opinion.
“Also, for the purpose of continuing the war, it is known to be of utmost importance to extract all the information in the possession of those detainees, while there is a real fear that its leakage to unauthorized parties could lead to harm to human life,” she continued.
